Nanci Clarence just returned from Miami, where she was a panelist at the American Bar Association’s National Institute on White-Collar Crime. The title of the panel presentation was “ESI: Will There Ever Be Rules?” The discussion focused on electronic stored information and the challenges presented by massive productions of electronic discovery in complex white-collar cases. Nanci presented the perspective of the private defense lawyer who must efficiently identify the needle in the haystack of data that is commonly produced by the government in federal criminal cases.
