The September/October white-collar issue of The Champion Magazine includes an article by Josh Cohen entitled “Is Title III Dead? The Future of Wiretap Challenges In the Wake of Rajaratnam.” Mr. Cohen argues that the Second Circuit’s recent decision admitting wiretap evidence at the trial of hedge fund titan Raj Rajaratnam was wrongly decided and, if permitted to stand, would effectively emasculate Title III’s necessity requirement.
